To qualify, your refund request must be submitted within 10 calendar days of the original purchase date.
Approved refund requests will receive 95% of the original purchase price.
The remaining 5% of the original purchase price is non-refundable and retained to help cover payment processing, transaction, administrative, and related costs associated with the purchase and refund.
After the 10-day refund period expires, the purchase is final and no refund will be provided except where otherwise required by applicable law.

Refund eligibility is determined according to the terms in effect at the time of the applicable purchase.

The Federal Arbitration Act (“FAA”) will govern the interpretation and enforcement of this arbitration agreement.

The arbitrator’s award will be final and binding, subject to any review expressly permitted by the Federal Arbitration Act, and judgment on the award may be entered in a court having jurisdiction.

Nothing in this arbitration provision prevents Ultimate Trade Indicator from seeking appropriate injunctive or equitable relief concerning actual or threatened infringement, misappropriation, unauthorized distribution, or misuse of its intellectual property where such relief is legally available.
25. CLASS ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ULTIMATE TRADE INDICATOR AGREE THAT CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING.
UNLESS BOTH PARTIES EXPRESSLY AGREE OTHERWISE IN WRITING, AN ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON OR PRESIDE OVER A CLASS, COLLECTIVE, MASS, OR REPRESENTATIVE PROCEEDING.
If applicable law renders this waiver unenforceable with respect to a particular claim or remedy, the effect of that determination will be governed by applicable law.
26. SEVERABILITY
Except where the arbitration or class-action provisions expressly require a different result, if a provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed as necessary, and the remaining provisions will continue in effect.
27. NO WAIVER
Failure by Ultimate Trade Indicator to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it later.
28. ASSIGNMENT

Ultimate Trade Indicator may assign its rights and obligations in connection with a legitimate merger, acquisition, sale, restructuring, or transfer of its business or assets, subject to applicable law.
